while under the law, horses are property, in a landslide case several years ago a couple was awarded punitive damages for the loss of their animal that was sold to slaughter without their knowledge. it was the first ruling of its kind, and with a good atty, this can can be referenced and used as leverage to support the argument that to many people, horses are more than just "possessions" but seen as part of the family.

also be warned that the owners are responsible for the care of the horse as much as the boarding facility within reason - meaning that if the owner(s) can prove that they were unable to get to the facility to check on the animal for whatever reason for the time in question, then they are fine. i know nothing of your situation but just bring this up b/c i also know of a case where a barn was found grossly negligent in the care of the animals and the spca was involved and the result was lawsuits against both the boarding facility owners as well as the individual horse owners. one owner had her case dismissed b/c she lived out of state and sent her horse there to rehab or something (i'm sorry i forgot the details and specifics) while other owners were held responsible along WITH the boarding facility owner/manager.

legal stuff can be tricky - i'm very sorry to hear about your friend's horses. i do know that brian macnamara of warwick veterinary clinic is also an atty and a brilliant man. if he can't take your case (not sure if he's currently practicing as he also has an equine surgical clinic), but if not i'm sure he can recommend someone who can. good luck to you and your friend.
